Dan Gus has spent his entire professional career in Texas after graduating magna cum laude from Boston College Law School and completing additional clinical training through Harvard Law School.

Dan started his legal career in the 1990s with a national law firm headquartered in Dallas. After several years with that firm, Dan joined a private investment firm as an attorney and the financial controller for a derivatives investment portfolio with more than $1 billion in assets.

After gaining valuable business experience in the investment world, Dan returned to private practice as a partner with a commercial litigation boutique where he regularly handled complex commercial litigation for corporate clients in state and federal trial and appellate courts.

In 2013, Dan launched his own firm to provide more responsive and cost-effective representation for his clients.

Representative Experience

Real Estate

Represented a real estate investment fund to recover misrepresentation and breach of contract damages arising out of the funds $6.5 million loan for the acquisition of large real estate development in Tennessee. Litigating in federal district court in Tennessee and in state district court in Houston, Texas, Dan helped the client obtain more than $3 million in settlements and judgments against the parties involved in the transaction.

Dan represented a Boston based real estate investment fund in a malpractice suit against an international law firm whose negligence had resulted in default judgment against the real estate investment company and the loss of more than $2 million held in escrow in a $32 million real estate investment. Dan Gus defeated the law firm’s multiple efforts to obtain summary judgment. Ultimately, the case settled for almost 100% of the client’s actual damages.

Dan successfully prosecuted an appeal that reversed a commercial lease termination.

Utilities

Dan represented a Texas electricity wholesaler in complex litigation arising out of three long-term power purchase agreements involving west Texas wind farms owned by a national power generation company. Despite litigating in an unfavorable forum, Dan and his team persisted through several adverse pre-trial rulings and persuaded the jury to award his client $8.9 million and reject every counterclaim made by the other party.

Dan filed a lawsuit in an Arizona federal district court on behalf of a Texas utility company against a California hospital system to recover $3.7 million in breach of contract damages arising out of utility company’s construction of power co-generation facility at a California hospital. Dan recovered the full $3.7 million owed to his client.

Telecommunications

Dan represented a telecommunications broker in a lawsuit against an international teleconferencing services company suit to recover hundreds of thousands of dollars in unpaid commissions. After trying the case to a federal district judge, Dan tried case before a federal district judge and recovered judgment for past and future commissions as well as attorney’s fees. The federal judge also rejected all of the counterclaims asserted by the teleconferencing company.

Banking

Dan represented Frost National Bank in a mandamus proceeding to enforce jury waiver in commercial loan agreements involving more than $16 million. The Dallas court of appeals granted the requested relief, which paved the way for the bank to obtain a judgment for the full amount of the loan deficiency.

Intellectual Property

Dan represented a game developer in a lawsuit against a game publisher and distributor to recover nearly $600,000 in damages arising out of the breach of a purchase agreement and employment agreement.

Prosecution of a trademark and copyright infringement action on behalf of a leading apparel manufacturer in federal district court in New York against a Korean national who illegally used the manufacturer’s trademarks and copyrighted materials.

Oil & Gas

Dan obtained a judgment for more than $800,000 in a breach of contract lawsuit filed by a land services company against a Texas oil and gas developer.

Filed suit in federal district court in Ohio to recover damages for an oil and gas professional who suffered substantial damages in connection with a faulty medical device implant. We obtained a six-figure settlement for the client.

Construction

Defended a general contractor specializing in agricultural construction against an insurance company’s subrogation claim for millions of dollars in damages arising out of the collapse of a grain elevator system. Based on our work, the insurance company abandoned the subrogation claim.

Succesfully prosecuted a civil case to recover damages and fees arising out of a multi-employee embezzlement scheme.

Defended a general contractor against a municipality’s claim of water intrusion damages in connection with a senior citizen center constructed by the contractor. After we showed that the water intrusion problems resulted primarily from design defects for which the contractor was not responsible, the municipality accepted the contractor’s remediation plan that cost only a fraction of the cost of the plan developed by the municipality’s consultants.
